Our firm represented companies from the Netzba Group in a lawsuit filed against them by the parking lot owners’ organization at the new central station complex (BTM organization), in which the plaintiffs sought to declare that they are entitled to a share in the common property and building rights (existing and future rights) in the central station complex. Netzba argued that the lawsuit should be dismissed outright, a position that was fully accepted by the Tel Aviv District Court – which ordered its dismissal on the grounds of claim preclusion and due to exemption and release provisions from claims and liabilities set forth in the creditors’ arrangement that was long ago approved for the central station companies in the liquidation proceedings. This is a significant decision with considerable economic implications, given the future plans to evacuate the central station complex and the aspiration to transform it from a “white elephant” into a thriving center.
