For the first time, a claim was filed with the District Court for the specific application of the recommendations of the Kaminetz Report, to examine the implications of the coronavirus on the upholding of contracts.

Our firm is representing the hotel chain, Brown, in a claim that was filed with the Tel Aviv District Court for compensation and restitution of millions of shekels against the Zvieli Group, which leases to the Plaintiff four hotels and a parking garage in Tel Aviv.
In the claim, the Brown chain is claiming, among other things, that the Zvieli Group took advantage of the coronavirus crisis, with an extreme lack of good faith, and also frustrated an engagement between the Brown chain and the Ministry of Defense for the purpose of operating a “coronavirus hotel” at one of the hotels.
In the claim, the court is being requested, for the very first time, to give teeth to the Kaminetz Report, and to take an active and creative step, while establishing an adjusted payment mechanism, when it comes to examine the contractual agreements between the parties, and also to grant validity to the requirements of good faith that were set forth in the recommendations of the interministerial team, headed by the Deputy Director-General, Kaminetz, which examined the implications of the coronavirus on the upholding of contracts.
The hotel chain, Brown, was represented by the partner Orly Tenennbaum, together with associates Shachar Eisner and Talia Ben Natan Haninkes.
