Gornitzky represented the foreign company Edelweiss Financial, together with four additional defendants in the dismissal in limine of a proceeding in the amount of NIS 12 million.

Gornitzky represented the foreign company Edelweiss Financial, together with four additional defendants before the Tel Aviv-Jaffa District Court in the dismissal in limine of a proceeding which was based, inter alia, on claims regarding the breach of officers’ duties, as well as actions taken not in the company’s best interest, in the amount of NIS 12 million.

Prior to the dismissal of the proceeding, the court also dismissed the plaintiff’s request for exemption from the proceeding fees, finding its claims in such request unreliable.

In light of the fact that the plaintiff did not adhere to the court’s decision, a motion to dismiss the proceeding was filed, and in its decision to order the dismissal of the proceeding, the District Court accepted all of the defendants’ claims, ordering the dismissal of the proceeding and the plaintiff to pay procedural costs.
